Terms of Service

1. Acceptance of terms

By accessing or using HookHero ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. You must be at least 13 years old (or the minimum age of digital consent in your country) to use HookHero. By using the Service, you represent that you meet this requirement and, if applicable, have authority to bind your organisation.

2. Who you are contracting with

These Terms constitute an agreement between you and HookHero AI Suite("we", "us", "our"). HookHero AI Suite is the seller of the Service.

3. Description of the Service

HookHero is an AI-powered content creation platform that generates hooks, captions, hashtags, scripts, and content ideas for social media platforms including TikTok, Instagram, and YouTube.

4. Account and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep it up to date.

5. Acceptable use

You agree not to misuse the Service. Prohibited conduct includes:

• Using the Service for any unlawful purpose.
• Generating or distributing illegal, harmful, abusive, hateful, or discriminatory content.
• Creating deepfakes, disinformation, or content intended to deceive or mislead.
• Attempting to bypass usage limits, security controls, or access restrictions.
• Reverse engineering, scraping, or probing the Service.
• Infringing intellectual property rights or the rights of others.
• Uploading malware, viruses, or interfering with the Service's operation.

6. AI-generated content

Outputs generated by HookHero are produced by artificial intelligence. You are responsible for your prompts, how you use the outputs, and for verifying the accuracy and appropriateness of generated content before publishing it. Generated content may be inaccurate or unsuitable for regulated professional advice without human oversight. We reserve the right to remove or restrict access to outputs that violate our policies.

7. Intellectual property

HookHero AI Suite retains all ownership and intellectual property rights in the Service, including its software, documentation, branding, and underlying technology. We grant you a limited, non-exclusive, non-transferable licence to use the Service within the limits of your selected plan. You retain ownership of the inputs you provide and the outputs you generate, subject to our right to use inputs solely to provide and improve the Service.

8. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically unless cancelled before the next billing period. Upgrades and downgrades may take effect immediately with proration at our discretion.

9. Service level

We aim to keep the Service available and performant, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability.

10. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms; non-payment; fraudulent or abusive activity; security risk; or repeated or serious policy violations. Upon termination, your licence to use the Service ends immediately.

11. Disclaimers and liability

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, except where prohibited by law.

12. Indemnity

You agree to indemnify and hold harmless HookHero AI Suite from claims arising out of your use of the Service, your content, or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which HookHero AI Suite operates, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction.

14. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting an updated version on this page with a revised effective date. Continued use of the Service after changes constitutes acceptance.
